2. Our Role Under GDPR

Under the General Data Protection Regulation (EU) 2016/679 (GDPR), as implemented in Sweden through the Data Protection Act (Lag 2018:218), IKAG acts as the data controller for any personal data collected through this website or in connection with our services.

The Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY) is the supervisory authority responsible for overseeing GDPR compliance in Sweden. Their website is www.imy.se.

3. What Personal Data We Collect

3.1 Data you provide directly

When you contact us through the website, by email, WhatsApp, or phone, we may collect:

•      Your name

•      Your email address

•      Your phone number

•      The address of the property you would like us to look after

•      Any additional information you choose to share in your message

 

3.2 Data we collect when you become a client

When you enter into a service agreement with us, we additionally collect:

•      Billing information (name, address for invoicing purposes)

•      Property access information (key arrangements, alarm codes, gate codes) - held securely and never shared with third parties

•      Property condition notes and records from our inspection visits

•      Correspondence history related to your property

 

3.3 Data collected automatically by the website

This website is built on Webflow. Webflow may collect basic technical data such asyour IP address and browser type for the purpose of delivering the website to you. This is functional data necessary for the operation of any website and does not require your consent under Swedish law.

4. Why We Process Your Data and the Legal Basis

We only process your personal data when we have a lawful basis to do so under GDPR Article 6. The table below explains each processing activity and its legal basis:

 

Responding to your enquiry - Legal basis: Legitimate interest (Article 6(1)(f)). We have a legitimate interest in communicating with potential clients who have contacted us voluntarily.

 

Providing caretaking services under a service agreement - Legal basis: Performance of a contract (Article 6(1)(b)). Processing is necessary to fulfil our obligations to you as a client.

 

Issuing invoices and maintaining financial records - Legal basis: Legal obligation (Article 6(1)(c)). Swedish accounting law (Bokföringslagen) requires us to retain financial records for seven years.

 

Storing property access information securely - Legal basis: Performance of a contract(Article 6(1)(b)). This information is required to deliver the service.

 

Sending visit reports and service updates - Legal basis: Performance of a contract(Article 6(1)(b)). Reports are a core deliverable of the service.

5. How Long We Keep Your Data

We do not keep your data longer than necessary. Specifically:

•      Enquiries that do not result in a service agreement: deleted or anonymised within 12 months of last contact.

•      Active client data (contact details, property information, service records): retained for the duration of the service agreement and for 3 years after the agreement ends, in case of any dispute or warranty claim.

•      Financial and invoicing records: retained for 7 years in accordance with Swedish accounting law(Bokföringslagen 5 kap. 2 §).

•      Property access codes and key information: deleted within 30 days of the service agreement ending.

6. Who We Share Your Data With

We do not sell, rent, or trade your personal data to any third party.

We may share limited data with the following categories of service providers, strictly as necessary to operate our business:

•      Accounting software (for invoicing purposes): your name, address, and invoice amounts may be stored inour accounting system.

•      Email providers (forsending invoices and correspondence): standard email transmission applies.

•      Sub-contractors or specialist tradespeople engaged to work on your property at your request: we will share only the property address and relevant access information necessaryto complete the work, and only with your knowledge.

Allthird-party tools we use are bound by their own GDPR-compliant privacy policies. We do not use any US-based cloud services that would require us totransfer your data outside the EU/EEA without appropriate safeguards.

7. Your Rights Under GDPR

As adata subject, you have the following rights under GDPR. To exercise any ofthese rights, contact us at info@ikag.se. We will respond within 30 days.

 

Right of access (Article 15)

You have the right to request a copy of the personal data we hold about you, free of charge.

 

Right to rectification (Article 16)

If any data we hold about you is inaccurate or incomplete, you have the right to ask us to correct it.

 

Right to erasure — 'right to be forgotten' (Article 17)

You have the right to request that we delete your personal data, where we no longer have a lawful basis to retain it. Note that we may be required to retain certain financial records under Swedish law regardless.

 

Right to restriction of processing (Article 18)

You have the right to ask us to pause processing of your data in certain circumstances, for example while a dispute is being resolved.

 

Right to data portability (Article 20)

Where we process your data on the basis of a contract and by automated means, you have the right to receive your data in a structured, commonly used, machine-readable format.

 

Right to object (Article 21)

You have the right to object to processing based on our legitimate interest. We will cease that processing unless we can demonstrate compelling legitimate grounds which override your rights.

 

Right to lodge a complaint

If you believe we have handled your personal data unlawfully, you have the right to lodge a complaint with the Swedish Data Protection Authority (IMY) atwww.imy.se or by post to: Integritetsskyddsmyndigheten, Box 8114, 104 20Stockholm, Sweden.

8. Data Security

We take the security of your personal data seriously. We implement the following measures:

•      Property access codes and sensitive access information are stored securely and are never transmitted via unencrypted channels.

•      Our email communications use standard TLS encryption in transit.

•      Access to client data is restricted to Andrei Rusu (the sole operator of IKAG). No third party has access to client files without a specific, documented reason.

•      Physical key management follows strict protocols - client keys are never labelled with the property address.

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the IMY within 72 hours as required by GDPRArticle 33, and will notify you without undue delay where the breach is likely to result in a high risk to you.

9. Cookies

This website uses only functional cookies that are strictly necessary for the website to operate. These cookies do not track you across websites, do not collect personal data for marketing purposes, and do not require your consent under Swedish law (Lag 2022:482 om elektronisk kommunikation, Chapter 9 Section28).

We do not use advertising cookies, analytics cookies, or any third-party tracking technologies. If this changes in the future, we will update this notice and implement a cookie consent mechanism accordingly.

10. Children's Privacy

Our services are directed exclusively at adult property owners. We do not knowingly collect personal data from anyone under the age of 18.

11. Changes to This Privacy Notice

We may update this privacy notice from time to time to reflect changes in our practices or applicable law. The 'Last updated' date at the top of this document indicates when the most recent changes were made. For material changes, we will notify active clients directly by email.
